The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall be issued, but upon probable cause, supported by oath or affirmation and particularly describing the place to be searched, and the person or thing to be seized. This is in consonance with FUNDAMENTAL RIGHTS: Chapter III, Article 21 (B) of the 1986 Constitution of the republic of Liberia. Liberians, like Americans, have always valued their privacy. They expect to be left alone, to be free from unwarranted snooping or spying, and to be secure in their own homes.

THE CRIMINAL JUSTICE PROCESS
The criminal justice process includes everything that happens to a person from arrest through conviction to release from the control of the state. Freedom may be gained almost immediately-at the station house-or after serving time in a correctional institution. Note that there are various places in which a person can exit the system without completing it. The juvenile justice process is different from that of typical state criminal justice system through which an adult passes when charged with a felony.

For a conviction to occur in a criminal case, the prosecutor must establish beyond a reasonable doubt that the defendant committed the act in question. The defendant is not required to present a defense but can instead simply force the government to prove its case. However, a number of possible defense are available in a criminal case.

In this category are the defense of infancy, intoxication, insanity and entrapment.

Infancy

Traditional, children of very young age, usually under seven, in the U.S.A., where considered legally incapable of committing a crime. Children between the ages of 7 to 14 were generally presumed capable of committing a crime, but this presumption could be show to be wrong, under our modern laws in Liberia. Simply provide that children under a specified age shall not be tried for their crime but shall be turned over to the juvenile court.

Controversial crimes are those offenses considered to be crimes against society in general. They often involve issues of personal conduct, public health, or social welfare. The offenses are sometimes called victimless crimes.
